2. Collection and storage of personal data; type and purpose of its use
2.1. Preamble
Within the app, we enable you to retrieve and display the following information:
- listing and controlling any of our Music Centres within your network;
- taking photos during the ripping process to store album covers.
Whenever you use the app, we process personal data about you. Personal data means any information relating to an identified or identifiable natural person. Protection of your privacy whenever you use the app is important to us. Therefore, we would like to provide the following information to you concerning the personal data we process when you use the app and the methods we use to handle this data. In addition, we will inform you about the legal basis for the processing of your data and, insofar as the processing is necessary to safeguard our legitimate interests, of our legitimate interests. You may access this Privacy Policy at any time by visiting the "Privacy Policy" menu item within the app.
3. Information on the processing of your data
Certain information will be processed automatically when you start using the app. Below, we specified for you which personal data will be processed:
3.1 Information collected during download
When you download the app, certain information we need to have will be transmitted to the app store you have selected (e.g. Google Play or the Apple App Store); in particular, this may include the processing of the user name, e-mail address, customer number of your account, time of download, payment information and individual device identification number. This data will be exclusively processed by the Google Play Store or the Apple App Store; we are not in control of their activities.
3.2 Use of the BURMESTERMC app
When using the app, data is retrieved directly from the Music Centre and transferred back to the Music Centre once you close the app. The data will not be stored on the mobile device. The app also needs to have the following permissions:
- Camera access: Access to the camera is required to capture an album cover of a CD during the ripping process.
The data will be processed and used for the purpose of providing that service. The legal basis for processing is your consent pursuant to point (a) of Art. 6(1) of the GDPR.
4. Disclosure of data to third parties
Your data will in no case be transferred to third parties
5. Rights of data subjects
As a user of the website, you have the right:
- pursuant to Article 15 of the GDPR, to access your personal data processed by Burmester. In particular, you may obtain access to information regarding the purposes of the processing, the categories of personal data concerned, the categories of recipients to whom your personal data have been or will be disclosed, the envisaged storage period, the existence of the right to request rectification, erasure, restriction of processing or to object to the processing, the right to lodge a complaint, the source of your data if they were not collected by Burmester, as well as the existence of automated decision-making including profiling and, where applicable, meaningful information about its particulars;
- pursuant to Article 16 of the GDPR, to request rectification of inaccurate personal data or to have incomplete personal data stored by Burmester completed without undue delay;
- pursuant to Article 17 of the GDPR, to request erasure of your personal data stored by Burmester, unless its processing is required for exercising the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defence of legal claims;
- pursuant to Article 18 of the GDPR, to request restriction of processing of your personal data insofar as you contest its accuracy, if its processing is unlawful but you object to its erasure and Burmester no longer require the data, but you require it for the establishment, exercise or defence of legal claims, or if you have objected to the processing in accordance with Article 21 of the GDPR;
- pursuant to Article 20 of the GDPR, to receive your personal data, which you have provided to Burmester, in a structured, commonly used and machine-readable format, or to transmit it to another controller;
- pursuant to Article 7(3) of the GDPR, to withdraw, at any time, any consent you have given Burmester. The consequence is that Burmester will, in future, no longer be allowed to continue any data processing which was based on this consent; and
- pursuant to Article 77 of the GDPR, to lodge a complaint with a supervisory authority. For this purpose, you may usually consult the supervisory authority of your customary place of residence or work or that competent of Burmester’s company headquarters.
6. Right to object
Pursuant to Article 21 of the GDPR, where your personal data is processed based on legitimate interests in accordance with point (f) of Article 6(1) of the GDPR, you have the right to object to the processing of your personal data on grounds relating to your personal situation or where such objection is brought against direct marketing. In the latter case, you have a general right to object, which Burmester will implement without any particular situation being stated.

7. Data security
Burmester uses appropriate technical and organisational security measures to protect your data against accidental or deliberate manipulation, partial or complete loss, destruction or access by unauthorised third parties. These security measures will be continuously improved to keep up with technological developments.

This Privacy Policy is currently valid and was last updated in August 2022. Due to the continued development of the product range we offer or because of changes to legal or official regulations, it may become necessary to amend this Privacy Policy.
